By accessing or using the Evocultiva.org website (the "Site"), you agree to comply with these Terms and Conditions. If you do not agree, you must refrain from using the Site. Evocultiva.org reserves the right to update or modify these Terms at any time with immediate effect upon posting. Continued use of the Site after changes are made constitutes your acceptance of the updated Terms.

These Terms apply to all visitors, registered users, buyers, and farmers (sellers) who access or use the Site in any capacity.

You agree to use the Site solely for lawful purposes and in compliance with all applicable local, national, and EU laws. Prohibited activities include:

• Selling or listing illegal goods, prohibited crops, or controlled substances.
• Posting harmful, misleading, defamatory, or offensive content.
• Unauthorised scraping, hacking, or interference with Site operations.
• Violating any intellectual property rights.
• Posting pornographic or explicit content of any kind.
• Impersonating another person, business, or entity.
• Using automated tools to create fake accounts, manipulate reviews, or spam users.

Evocultiva.org reserves the right to suspend or permanently ban access without prior notice. We cooperate fully with law enforcement where required by law.

All products on AlimentaMapa are listed and sold by independent third-party farmers. To the fullest extent permitted by applicable law, Evocultiva.org shall not be liable for:

• The quality, safety, legality, or accuracy of products listed by third-party sellers.
• Any loss, damage, injury, or illness arising from the purchase or consumption of products sold through AlimentaMapa.
• Any failure by a farmer or buyer to fulfil their obligations in a transaction.
• Any indirect, incidental, consequential, or punitive damages arising from use of the Site.
• Loss of data, revenue, profits, or business opportunities.
• Any content posted by users, including reviews, product descriptions, or farm information.

Our total aggregate liability to you shall not exceed the total fees paid by you to Evocultiva.org in the three months preceding the relevant claim.

Farmers and producers who list products on AlimentaMapa confirm that they:

• Hold all required licences, registrations, and permits to sell the products they list, including food hygiene, organic certification, or local trading licences.
• Take full legal responsibility for the accuracy of product descriptions, including ingredients, allergens, and certifications.
• Comply with all applicable EU and local food safety regulations, including Regulation (EC) No 178/2002.
• Will not list products that are banned, restricted, or require special authorisation without holding that authorisation.
• Accept sole responsibility for the fulfilment, packaging, and delivery of their products where delivery is offered.
• Agree that Evocultiva.org may remove any listing at any time for violation of these Terms, applicable law, or platform standards.

Evocultiva.org may require evidence of licences or certifications at any time. Failure to provide such evidence may result in immediate account suspension.

Evocultiva.org does not verify or guarantee the accuracy of any product listing, description, price, or availability posted by independent farmers. All such information is provided by the farmer and is their sole responsibility.

If a product is unavailable or out of stock after an order has been placed, the buyer will be notified and offered alternatives, a backorder option, or a full refund.

Product images are for illustrative purposes only and may not exactly represent the product received.

By placing an order on the Site, you make an offer to purchase the selected products. Evocultiva.org reserves the right to refuse or cancel any order at any time for reasons including pricing errors, availability issues, suspected fraud, or policy violations.

All payments are processed securely through Stripe. Evocultiva.org does not store card details. A platform commission of 5% is deducted from each transaction before the remainder is paid to the farmer.

Placing an order constitutes acceptance of the relevant farmer's product terms and of these Terms and Conditions in full.

For products purchased directly from the Evocultiva Store (not AlimentaMapa), Evocultiva.org is the seller and takes full responsibility for fulfilment.

For AlimentaMapa orders, shipping is the sole responsibility of the individual farmer. Evocultiva.org mediates shipping disputes but does not manage, guarantee, or insure any shipments made by farmers.

For Evocultiva Store orders, we aim to process and ship within 7 working days. Delivery estimates are not guaranteed and may vary due to carrier delays, weather, or customs.

For international shipments, customs duties, import taxes, or fees imposed by your country are your sole responsibility and are not included in the listed price.

You must contact Evocultiva.org within 3 working days of receiving your order to initiate a return or refund. Returns are processed through our dispute resolution channel and refunds are issued to the original payment method.

Return shipping costs are your responsibility unless the item is defective, incorrect, or an error occurred on the part of the farmer or Evocultiva.org.

We reserve the right to refuse a refund if the item has been used, damaged by the buyer, or is not in its original condition. Perishable food items delivered in satisfactory condition are generally non-refundable.

For AlimentaMapa orders, refunds are subject to the farmer's cooperation. Evocultiva.org will mediate but cannot guarantee a refund where a farmer disputes a claim in good faith.

Any dispute between a buyer and a farmer should first be raised through the Evocultiva.org dispute resolution channel. We will make reasonable efforts to mediate fairly. If no resolution is reached within 30 days, either party may pursue independent legal remedies.

These Terms are governed by the laws of Spain. Any legal proceedings shall be subject to the exclusive jurisdiction of the courts of Navarra, Spain, unless otherwise required by applicable consumer protection law in your jurisdiction.

Nothing in these Terms limits any statutory rights you may have under applicable consumer protection legislation.

All content on Evocultiva.org — including text, graphics, logos, images, software, and design — is the property of Evocultiva.org or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or commercially exploit any content without express written permission.

By uploading content to the Site (including product images, descriptions, or reviews), you grant Evocultiva.org a non-exclusive, royalty-free, worldwide licence to use, display, and promote that content in connection with operating the platform.

Your use of this Site is governed by our Privacy Policy, incorporated into these Terms by reference. By using the Site you consent to the collection and use of your data as described therein.

Evocultiva.org complies with the EU General Data Protection Regulation (GDPR). You have the right to access, correct, delete, or restrict processing of your personal data at any time by contacting us.

We do not sell your personal data to third parties. Payment data is handled entirely by Stripe and is not stored on our servers.

Evocultiva.org reserves the right to suspend or permanently terminate any user account without prior notice if we believe a user has violated these Terms, engaged in fraudulent activity, or poses a risk to the platform or its users.

Upon termination, your right to use the Site ceases immediately. Outstanding obligations — including amounts owed — survive termination.

You may request deletion of your account at any time by contacting us. Requests will be processed within 30 days, subject to legal obligations requiring us to retain certain records.

The Site and all content, products, and services available through it are provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied.

Evocultiva.org does not warrant that the Site will be uninterrupted, error-free, or secure, nor that any product sold through AlimentaMapa is fit for purpose, defect-free, or accurately described.

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

Evocultiva.org shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, pandemics, strikes, government actions, power outages, internet disruptions, or third-party service failures (including payment processors).

If any provision of these Terms is found unenforceable or invalid, it shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evocultiva.org and supersede all prior agreements or understandings. Our failure to enforce any provision does not constitute a waiver of our right to enforce it in future.
